All prices displayed in the online store are retail and include VAT as well as the HRK 0.50 deposit value in case of items on which container deposit is charged under applicable regulations.

All prices are in Croatian kunas (HRK).

Prices and terms and conditions of sale may differ between the online store and our offline shop.

The cost of delivery is not included in the price. TERRA ENO OLEA d.o.o. reserves the right to change prices at all times.

Payment Methods

Payments can be made by:
Credit cards – Our store accepts payments with credit cards such as Visa, MasterCard and Maestro.

Bank transfer – When we receive your order, we will email you a quote with relevant information on the total price and our bank account number (IBAN).

The indicated amount must be paid into our account before we can proceed with the shipment of the products you ordered.

Delivery Methods

If the goods you purchased are available, all orders made by noon will be shipped the following day, and other orders will be shipped the following business day or immediately after the purchased products become available.

Delivery may take up to several days (depending on the place and/or conditions of delivery). We provide door-to-door delivery to all addresses.

The price of shipping is automatically calculated on the “Cart” page. The price varies depending on the weight of the package and the place or country of delivery.

If you haven’t received your package, please inform the Seller as soon as possible. The Seller will take all necessary measures to find your package and/or send you a new one.

By purchasing goods, the Customer agrees to provide a mobile phone or telephone number to be printed on the package to facilitate and speed up the delivery.

Delivery and Packaging

Ordered products are packed in special packaging to prevent damage during normal handling. Products can be delivered to Croatia and 22 EU countries and regions. Upon delivery, the Customer is obliged to check the condition of the package and immediately report any damage to the delivery person (courier company employee). The Seller disclaims all liability for any damage that may occur during delivery. Every package is insured against damage during delivery. Customers will receive shipment status information on their mobile phone so please provide your mobile phone number when placing your order.

If the Customer has not received the goods or a delivery notice within the expected period after shipping, the Customer has the right to inform the Seller, who will then take actions to find the package or send a replacement package.

If the Customer refuses to receive the ordered goods, the Seller has the right to request the reimbursement of any and all costs of delivery.

The Seller will send the package to the Customer immediately upon receiving the approval of the online transaction. After receiving the approval, the Seller will ship the package within 5 (five) business days.

Once the courier (the delivery company) has received the package from the Seller, the Seller is no longer responsible for the further course of delivery or any delays and problems that may arise in connection with further handling and delivery of the goods.

Age Restrictions on Alcohol and Alcoholic Beverages

The sale of alcoholic beverages to persons under 18 years of age is prohibited. At the courier’s request, the Customer is required to present a document proving their legal age.

The Customer confirms that they are of legal age by browsing the online store.

Customer Complaints

In accordance with the Customer Protection Act, the Customer has a full right to complain. A complaint is considered valid if it meets the terms and conditions of complaints under the mandatory law and act on consumer protection. The Customer is required to return products to the Seller by the agreed deadline and to the agreed address. The Seller must replace any damaged product or offer a full refund to the Customer within 14 days from the receipt of the complaint.

Online Payment Security Statement

To process online payments, our online store uses CorvusPay – an advanced system for secure acceptance of payment cards online.

CorvusPay guarantees complete confidentiality of your card data from the moment you enter the data in the CorvusPay payment form. Payment information is encrypted and forwarded from your web browser to the bank that issued your card. Our store never has full access to all information from your payment card. This data is inaccessible even to CorvusPay employees. The isolated core independently transmits and manages sensitive data, keeping it perfectly secure.

The payment form is secured by the SSL transport code, ensuring the highest degree of security. All stored data is additionally protected by encryption, using a FIPS 140-2 Level 3-certified cryptographic device.

CorvusPay meets all security requirements for online payments prescribed by leading card brands and operates in accordance with PCI DSS Level 1 – the payment card industry’s strictest security standard. When paying with cards enrolled in the 3-D Secure program, in addition to the validity of your card, your bank will also confirm your identity through a token or password.

Foreign Currency Translation Statement

All payments are made in the Croatian currency. Your credit card bill will be charged for the amount calculated by converting the price in euros into Croatian kunas, based on the current exchange rate of the Croatian National Bank.

When charging your credit card, the same amount will be converted to your local currency based on the credit card association’s exchange rate. Due to the conversion, the charged price may slightly vary from the original price listed on our website.

Method of Personal Data Protection

TERRA ENO OLEA d.o.o. will take all necessary precautions to ensure the protection of all personal data on our website. Confidential information is protected both online and offline. If our forms require confidential information, they will be encrypted by security protocol browsers (SSL), such as Internet Explorer, Google Chrome or Firefox with a padlock icon, indicating that the page is secure. If the padlock icon is locked, the page is secure. We use the encrypted SSL method to guarantee maximum security and maximum protection of your personal data, even offline. Access to our customers’ personal information is limited. Only employees who need this information to provide a service have access to strictly personal data. All employees of TERRA ENO OLEA d.o.o. and its business partners are responsible to adhere to privacy protection principles.

Collection of Personal Data

Byistria Shop is committed to the security of personal information of all customers and guarantees to collect only the minimum necessary personal data and disclose such data only when strictly necessary. We committedly provide information on the use of collected data to our customers and we always offer customers a free choice on how their data is being used, including the option to use their name in marketing campaigns. All customer information is rigorously protected and is only available to employees who strictly need this information to perform certain services. All employees and partners we work with are responsible for upholding the privacy policy.

Registration

You can make a purchase or send an inquiry on our website as a registered customer or as a guest. In both cases, the Customer will be asked to provide contact information (such as name, email address and mobile phone number for shipping purposes). This information is used to contact the Customer in case of questions on our website. In addition, we guarantee absolute privacy of the provided personal data as we offer the option to add and/or edit all data.

Notification of Change

In the event that we opt to change our privacy policy, you will be notified by a real-time update on our website. Customers will always be notified and informed on all information we collect, how we use it and under which conditions. If we opt to use the personal information of our customers, at any time, in a way that had not been defined at the time it was provided, all customers will be notified of the change by email. Customers will be given the option to consent to the use of their data in any new way. The data will always be used in accordance with the regulations in place at the time of collection.

Unilateral Termination of Contract

The User/Customer may unilaterally terminate the Contract within 14 (fourteen) days without stating a reason. The User has no right to unilaterally terminate the Contract:

  • if the service is fully performed and its performance started with the User’s explicit prior consent and confirmation that he/she is aware that he/she will lose the right to unilaterally terminate the Contract if the service is fully provided, if the subject-matter of the Contract is sealed goods that were unsealed upon delivery and therefore rendered unsuitable for return,
  • if the subject-matter of the Contract are goods that were, due to their nature, inseparably mixed with other objects upon delivery,
  • if the subject-matter of the Contract is a product or service whose price depends on financial market fluctuations that are beyond the influence of the Seller and which may occur during the term of the Buyer’s right to unilaterally terminate the Contract,
  • if the subject-matter of the Contract is a product that has been produced according to the Buyer’s specification or is clearly tailored to the Buyer,
  • if the subject-matter of the Contract is the delivery of alcoholic beverages whose price was agreed at the time of conclusion of the Contract but may only be shipped after 30 or more days, if the price is subject to market fluctuations that are beyond the Seller’s influence.
  • if more than half of the product has been consumed before the discovery of a defect.

To exercise the right to unilaterally terminate the Contract, the User/Customer must notify TERRA ENO OLEA d.o.o. of their decision to terminate before the expiry of the term, by sending an unambiguous statement by regular mail (to TERRA ENO OLEA d.o.o., Medulinska cesta 15, 52100 Pula) or to shop@byistria.com, including the name, address, number telephone, or email address of the Customer, or use the below Contract Termination Form.

The User may also fill out and send the below Contract Termination Form digitally, and TERRA ENO OLEA d.o.o. will send back a confirmation of receipt of the notification by email, without delay.

The deadline for unilateral termination of the Contract is 14 (fourteen) days from the date when the User, or a third party designated by the User, other than the carrier, received the goods under the Contract, and in case of services, from the conclusion of the Contract.

If the User unilaterally terminates the Contract, all payments will be refunded, including delivery costs, without delay, no later than 14 (fourteen) days from the date of receipt. The refund will be made in the same manner as payment.

The User is required to return the goods or send them to the address TERRA ENO OLEA d.o.o., Medulinska cesta 15, 52100 Pula, without undue delay, and in any case no later than 14 (fourteen) days from the date of sending the decision to unilaterally terminate the Contract. The direct costs of returns are borne by the User.

Under Article 77, paragraph 5 of the Consumer Protection Act, the User is responsible for any impairment of the goods resulting from the handling of the goods, other than as necessary to determine the nature, characteristics and functionality of the goods. In case of damage to the original packaging, the amount of the refund will be reduced by a percentage corresponding to the value of the goods. In this case, the User will be notified of the reduced refund amount.

If, at the User’s request, the provision of the service started during the unilateral contract termination deadline, the User is required to reimburse TERRA ENO OLEA d.o.o. for the amount proportional to the service delivered up to the date of notification on the unilateral termination of the Contract by the User to TERRA ENO OLEA d.o.o.

Refunds

In the event that the Customer has already paid for goods but the goods are out of stock for any reason (described under Delivery), we will make a refund within two business days. If necessary, we will also contact the Customer to check if they wish to receive partial delivery of any remaining order.

Claims/Complaints

Under the Consumer Protection Act, the Customer has the right to make a claim. A claim is valid if it meets the claim terms and conditions under the Civil Obligations Act and Consumer Protection Act. The Customer must return the product to the Seller, by sending it to the agreed address within the agreed time limit. The Seller must replace the product or refund the full amount paid within 14 days of receiving a valid complaint.

Any complaints should be made in writing and sent by regular mail or e-mail to the addresses listed under Contact. We will strive to respond as soon as possible.

Please inspect the goods upon delivery as we will not be able to accept subsequent complaints.

Internet Dispute Resolution

The special regulation of the European Union of 15 February 2016 provides for the resolution of disputes related to online shopping in the EU through a platform that may be accessed here.

This means that if you encounter a problem during an online purchase within the EU (defective product, inability to replace the product, etc.), you can file your complaint at the above link.
